Right-of-Way Permits | City of Minnetonka, MN

A right-of-way permit is required if a resident or utility company is obstructing or excavating in the road right-of-way or other public easements. A permit fee covers the city’s right-of-way management (permit review, processing, locating utilities, etc.). City Code Section 1120 applies to all work authorized by the permit.

Applying as a private utility

Utility companies must follow these procedures to obtain a right-of-way permit:

Before applying for your first permit, submit a registration packet that includes:
- Registration form
- Certificate of insurance
- Invoice agreement if you have been approved to be billed monthly or biannually (June 30 and Dec. 31). Only utility companies may apply to receive an invoice; do not submit this form if you have not been pre-approved.
Registration must be renewed each year.

Permit application

The following information must be submitted with a permit application:

Detailed plan sheets showing existing conditions, including streets, trails, existing utilities and distances from those features to the proposed work.
Detailed traffic control plan for lane closure or detour during the time of the project. An obstruction in a lane of traffic is a lane closure and traffic control must be provided.
Communications notice for informing affected residents.

Permit approval before starting work

Once permit is approved, applicant will be notified to provide payment or billed per the approved invoice agreement, unless there is a franchise agreement in lieu of fees.
Depending on the scope and type of work, a security deposit may be required in the form of a bond or escrow.
All affected residents must be notified before utility locates are performed.

Completing work

After permit is issued and work is completed:

Submit the certificate of completion when all work is complete, including final restoration, so city staff may perform a final inspection.
Submit as-builts by April 1 for the previous year’s work. The city prefers ArcView (shape file).
